1. Acceptance of These Terms

These Terms of Use ("Terms") form a legal agreement between you and Stefan-Andrei Pascutoi and Ana-Maria Cirtog, based in Bucharest, Romania ("PACE", "we", "us"), governing your access to and use of the PACE mobile application (the "Service"). By creating an account, ticking the consent checkbox during sign-up, or otherwise using PACE, you agree to these Terms and to our Privacy Policy (joinpaceapp.com/privacy). If you do not agree, do not use the Service. PACE is offered to runners and running clubs internationally. Some sections below note where additional local rules may apply.

2. The Service

PACE is a mobile app that helps you discover running clubs and group runs near you, join and check in to runs, follow and create routes, track your training and goals, connect (optionally) to Apple Health or Google Health Connect, take part in challenges, leaderboards and medals, and interact with other members through club feeds, posts, comments and reactions. Club admins get additional tools to schedule runs, manage membership, publish club rules, and recognise members. PACE is provided free of charge for personal, non-commercial use related to running and club activities. We may add, change, or remove features over time. Some features described in our roadmap are not enabled in this version — see Section 17.

3. Eligibility & Accounts

You must be at least 16 years old (or the minimum age of digital consent in your country, if higher) to create a PACE account. Sign-up requires a date of birth and accounts cannot be created below this age. By registering, you confirm that the information you provide is accurate and that you meet this age requirement. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you believe your account has been compromised. Each account is associated with a role — runner or admin. Admins have additional responsibilities described in Section 9.

4. Location Services

PACE uses your device's location, with your permission, to power features such as the Explore map (nearby clubs, runs and routes), the Home "Suggested" runs section (within a radius you choose, configurable in Explore), and directions to a run's meeting point. PACE requests location only while you are using the app. It does not use background or "always" location, and does not track your movements. You can grant, deny, or revoke location permission at any time in your device settings. If location access is off, location-based features will be unavailable or limited, but you can still use the rest of PACE (e.g. browsing clubs by name, your training log, challenges, and feed). You are responsible for your own safety and awareness of your surroundings while using location-based features, including while running, navigating to a meeting point, or using the app outdoors. See Section 8 ("Health & Safety").

5. Health Data Integration (Apple Health / Health Connect)

If you choose to connect Apple Health (iOS) or Google Health Connect (Android), PACE requests read-only access to running-related data — workouts, distance, duration, pace, workout routes, heart rate, resting heart rate, and VO₂max readings where your device records them — to power your run history, goals, training insights, personal bests, leaderboards, and medals. The full list is in our Privacy Policy, Section 7. PACE does not write to, modify, or delete any data in Apple Health or Health Connect. PACE does not sell, share, or otherwise disclose your health data to third parties, does not use it for advertising or marketing, and does not use it to train machine-learning models. Connecting a health source is optional and PACE works without it. You can disconnect at any time from Profile → Connected Sources.

6. Training Information Is an Estimate, Not Medical Advice

PACE calculates and displays training figures — including estimated fitness (VDOT), suggested training paces, heart-rate zones, session load, training-load ratios, efficiency trends, session classifications, personal bests, and equivalent race times. You must understand the following before relying on any of it: • These figures are estimates derived from consumer devices and general-population formulas. They are not measurements taken under medical or laboratory conditions, and they can be wrong — including materially wrong — for any individual. • Their accuracy depends on inputs you control, such as your maximum and resting heart rate. If those are unset or inaccurate, every figure derived from them will be inaccurate. • PACE is not a medical device, is not intended to diagnose, treat, cure or prevent any disease or condition, and does not provide medical advice. • Any load, recovery or intensity indication is descriptive, not a prescription. PACE does not know about your injuries, illnesses, races, or the rest of your life, and nothing it displays should be read as an instruction to train, to train harder, or to rest. • Decisions about your training and your health are yours, and should be made with a qualified coach or healthcare professional where appropriate. Do not use PACE as a substitute for professional advice, and do not disregard professional advice because of something PACE displayed. Distances shown for a club run may be the club's planned route distance rather than a distance measured on your device; where that is the case PACE labels it.

7. Your Content

PACE lets you post content such as profile photos, run stories, feed posts, comments, reactions, route descriptions, tips and reviews ("User Content"). You retain ownership of your User Content, but by posting it you grant PACE and the members of clubs you belong to a non-exclusive, royalty-free, worldwide licence to host, display, and distribute it within the app for the purpose of operating the Service. This licence ends when you delete the content or your account, except for copies already shared with others and for backups that age out in the ordinary course. You are solely responsible for your User Content. Do not post anything that is unlawful, infringes another person's rights, or that you do not have the right to share. We may remove User Content that violates these Terms or applicable law.

8. Acceptable Use & Objectionable Content

When using PACE, you agree not to: • Harass, bully, threaten, stalk, or discriminate against other members. • Post content that is hateful, violent, sexually explicit, or otherwise objectionable. • Impersonate another person or misrepresent your affiliation with any club. • Post false, misleading, or fraudulent run data, results, or content. • Attempt to access another user's account, or any non-public part of the Service, without authorisation. • Reverse-engineer, decompile, scrape, or interfere with the Service or its security features. • Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law. There is no tolerance for objectionable content or abusive behaviour on PACE. Reporting: if you see content or behaviour that violates these Terms, report it using the "Report" option on a post, or contact us via Profile → Help & Support or at team@joinpaceapp.com. We review reports and act on them within 24 hours of receipt, which may include removing the content and warning, suspending, or terminating the account responsible. Reported content is also surfaced to the admins of the club it was posted in. We may suspend or terminate accounts that violate this section, with or without notice, depending on severity.

9. Club Admins

If you are the admin of a club, you may access additional tools to manage members, runs, rules, challenges, communications, and analytics for that club. Admins must use these tools responsibly, in compliance with these Terms, applicable data protection law (including when communicating with or about members), and any additional club-specific guidelines. Admins are responsible for the accuracy of club-level content they create or approve (e.g. announcements, club rules, custom medals, challenge rules), for the safe organisation of runs they schedule, and for handling member information they can see only for the purpose of running the club. Admin actions are recorded in an audit log for the club.

10. Club Rules

A club may publish its own rules, which you may be asked to read and accept before joining the club or a run. Those rules are an agreement between you and that club — they are additional to these Terms and do not replace them. PACE hosts and displays club rules but is not a party to them, does not review them, and is not responsible for their content or enforcement. If a club's rules conflict with these Terms, these Terms govern your use of the app itself.

11. Fees

PACE is free to use. This version contains no subscriptions, no in-app purchases, and no paid features, and PACE does not collect payment details. If paid subscriptions, sponsor perks, or in-app purchases are introduced in a future version, this section will be updated first to describe pricing, billing, renewal, refunds, and how to cancel, in compliance with Apple's and Google's in-app purchase and subscription requirements, and you will be notified in-app before any charge is possible.

12. Account Suspension & Deletion

You may delete your account at any time from Profile → Delete My Account. This will delete your account and remove your personal data as described in our Privacy Policy. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if we discontinue the Service or a club you belong to. Where reasonably possible, we will provide notice before doing so.

13. Disclaimers & Limitation of Liability

To the maximum extent permitted by applicable law, PACE is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any figure it displays will be accurate. To the maximum extent permitted by applicable law, PACE and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, goodwill, or other intangible losses, arising from your use of (or inability to use) the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, liability for death or personal injury caused by negligence, or for fraud, in jurisdictions where such limitations are not permitted). If you are a consumer in the EEA or UK, your statutory rights are unaffected.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service or legal requirements. If we make material changes, we will notify you via an in-app notice before they take effect. Continuing to use PACE after changes take effect constitutes acceptance of the updated Terms, to the extent permitted by applicable law. If you do not agree to updated Terms, you should stop using the Service and may delete your account.

15. Governing Law & Disputes

These Terms are governed by the laws of Romania, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your country of residence give you additional rights or require a different governing law or forum (which will apply instead, to the extent required). Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Bucharest, Romania, except where applicable law requires that you be permitted to bring proceedings in your own country of residence — in which case that right is preserved. EEA/UK consumers: nothing in these Terms affects your right to rely on mandatory provisions of the law of the country in which you are resident, including your right to bring proceedings before the courts of that country. EU consumers may also use the European Commission's online dispute resolution platform.

16. Apple App Store — Additional Terms

The following applies if you obtained PACE from the Apple App Store. These terms are required by Apple and are in addition to the rest of these Terms: • These Terms are between you and us, not Apple. Apple is not a party to them, and we — not Apple — are solely responsible for PACE and its content. • Licence scope: your licence to use PACE is a non-transferable licence to use it on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. • Maintenance and support: we are solely responsible for providing any maintenance and support for PACE. Apple has no obligation to furnish any maintenance or support services. • Warranty: in the event of any failure of PACE to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to PACE, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility. • Product claims: we, not Apple, are responsible for addressing any claims relating to PACE or your use of it, including product liability claims, any claim that PACE fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation. • Intellectual property claims: if a third party claims that PACE infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim. • Legal compliance: you represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. • Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary. • Contact: questions, complaints or claims about PACE should be directed to team@joinpaceapp.com.

17. Features Not Enabled in This Version

PACE's roadmap includes club sponsors and perks, partner venues, races and virtual runs, direct messages between runners, and a "runners nearby" map. These features are switched off in this version and no part of these Terms relating to them is currently in effect. If any of them is enabled in a future version, these Terms and our Privacy Policy will be updated first and the update notified in-app before the feature goes live. In particular: • Events organised with third-party venues or partners may be subject to additional terms set by that venue or partner (for example venue access rules or waivers), which would be presented to you before you join the event. • If PACE introduces paid or ticketed events, Section 11 ("Fees") will be updated to describe pricing, billing, refunds, and cancellation before that feature becomes available.
